2. Description of services

Blazemist designs, manufactures, and supplies premium smart livestock monitoring systems and precision farming technology. This includes, depending on configuration and project scope, smart ear tags and collars with real-time monitoring signals (such as temperature trend support, activity, rumination proxies, and location events), barn and house environmental sensors (such as ammonia and humidity trend monitoring), connectivity gateways, and a cloud-based farm management platform for dashboards, alerts, and reporting exports.

The website provides information about Blazemist offerings and enables you to contact us for quotes, pilots, and engineering discovery. Any purchase, subscription, or implementation services may be subject to additional agreements (such as a quote, statement of work, maintenance agreement, or reseller terms). If there is a conflict between these Terms and a signed commercial agreement, the signed commercial agreement controls for that specific engagement.

Scope limitations: Blazemist systems are designed to support operational decision-making. They do not provide veterinary diagnosis, medical treatment, legal advice, or guaranteed compliance outcomes. Farms remain responsible for animal care, staff safety, and adherence to applicable EU, Dutch, and local rules.

3. User obligations

You agree to use the website lawfully and responsibly. You must provide accurate and current information when submitting inquiries, requesting documentation, or arranging a meeting. You are responsible for safeguarding any credentials that may be issued to you for a demo, pilot, or customer portal experience (if applicable).

• Use the site only for legitimate business and technical evaluation purposes related to Blazemist systems.
• Respect farm and operational confidentiality if you share third-party information. Only share what you are authorized to share.
• Maintain reasonable security practices when exchanging documents or integration details with Blazemist.

One account per person: if Blazemist provides access to a customer or pilot portal, you agree not to share accounts across multiple individuals. If you need multi-user access, request appropriate roles and permissions.

4. Intellectual property

The website and all related content, including text, graphics, product names, logos, designs, page layout, software code, firmware concepts, and documentation materials, are owned by or licensed to Blazemist B.V. and are protected by intellectual property laws.

Blazemist grants you a limited, non-exclusive, non-transferable, and revocable license to access and use the website for your internal business purposes, such as evaluating products and contacting us. You may not copy, reproduce, distribute, publicly display, modify, create derivative works from, reverse engineer, or otherwise exploit any portion of the site or related materials except as permitted by mandatory law or by prior written consent from Blazemist.

Any feedback you provide (such as feature requests or usability suggestions) may be used by Blazemist without restriction, provided we do not disclose your confidential information inappropriately. If you need a separate confidentiality agreement for detailed technical exchanges, contact us before sharing sensitive integration specifics.

5. Prohibited activities

You must not misuse the website or attempt to interfere with its operation, security, or availability. The following activities are prohibited:

• Attempting to gain unauthorized access to the site, forms, databases, systems, or any accounts.
• Scraping, harvesting, or collecting content or contact details at scale, including use of bots or automated tools without permission.
• Reverse engineering or attempting to derive source code, models, or proprietary logic from any Blazemist software or services accessed through the site.
• Uploading or transmitting malware, spyware, or any malicious code, or attempting denial-of-service attacks.
• Impersonating another individual or entity, misrepresenting affiliation, or submitting inquiries using false identity information.
• Using the site to send spam, unsolicited marketing, or abusive communications.
• Violating third-party rights, including intellectual property or confidentiality obligations.

Blazemist may investigate suspected misuse and may restrict access to protect the site and users. We may also cooperate with lawful requests from authorities where required.

6. Disclaimer of warranties

The website and any information provided through it are offered on an “as is” and “as available” basis. To the fullest extent permitted by applicable law, Blazemist disclaims all warranties, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from course of dealing or usage of trade.

Blazemist does not warrant that the site will be uninterrupted, secure, error-free, or free of harmful components. Content may contain technical inaccuracies or may become out of date. Product specifications, performance characteristics, and integration compatibility may vary by configuration and are confirmed during quotation and commissioning.

Decision support only: analytics, alerts, and dashboards are intended to assist operational decision-making. They do not constitute veterinary diagnosis or a guarantee of specific outcomes. You remain responsible for animal care, and you should consult qualified professionals where appropriate.

7. Limitation of liability

To the fullest extent permitted by applicable law, Blazemist will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, business, goodwill, data, or anticipated savings, arising out of or related to your use of the website or reliance on website content, even if Blazemist has been advised of the possibility of such damages.

To the fullest extent permitted by applicable law, Blazemist’s total direct liability for claims arising out of or related to the website or these Terms will not exceed the amount you paid to Blazemist for the website in the twelve months preceding the event giving rise to the claim, or EUR 100 (one hundred euros), whichever is lower. For clarity, access to the website is generally provided free of charge.

Some jurisdictions do not allow certain limitations of liability. In such cases, the above limitations apply to the maximum extent permitted by law.

8. Indemnification

You agree to indemnify, defend, and hold harmless Blazemist B.V. and its directors, employees, contractors, and affiliates from and against any claims, damages, liabilities, losses, and expenses (including reasonable legal fees) arising from or related to (a) your breach of these Terms, (b) your misuse of the website, or (c) your violation of any law or third-party rights in connection with your use of the website.

Blazemist may assume control of the defense of any matter subject to indemnification, in which case you agree to cooperate as reasonably requested.

9. Third-party links

The website may reference or embed third-party services (for example, map providers) for convenience. Third-party sites and services are not under Blazemist’s control. Blazemist is not responsible for the content, security, or privacy practices of third-party websites or services, and your use of them may be governed by their own terms and policies.

10. Privacy

Blazemist processes personal data in accordance with our Privacy Policy, which is incorporated into these Terms by reference. By using the site and submitting information to Blazemist, you acknowledge that you have read the Privacy Policy and understand how we collect, use, and share data.

11. Governing law and jurisdiction

These Terms are governed by the laws of the Netherlands, excluding its conflict of law provisions to the extent they would lead to another law applying. Subject to any mandatory consumer protection rules that apply, the courts of Gelderland, location Arnhem, Netherlands, will have exclusive jurisdiction over disputes arising out of or relating to these Terms or the website.

12. Dispute resolution

Before starting formal proceedings, you agree to contact Blazemist and attempt to resolve the dispute informally. The informal resolution period is 30 days from the date a written notice is sent to the other party describing the issue and the requested resolution.

If the dispute is not resolved within 30 days, either party may bring a claim in the courts identified in the governing law and jurisdiction section above, unless mandatory law provides otherwise.

13. Termination

Blazemist may suspend or terminate your access to the website (including any portal access, if provided) at any time, with or without notice, if we reasonably believe you have violated these Terms, used the site unlawfully, or created a security risk.

Upon termination, the license granted to you to use the website ends immediately. 14. Modifications

Blazemist may update these Terms to reflect changes to the site, legal requirements, or our business practices. Updated Terms will be posted on this page and become effective 14 days after posting, unless a change is required by law to take effect sooner.

Your continued use of the website after the effective date of updated Terms constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the site.
